Terms of Service

Welcome to NewJersey.Rentals, a vacation rental marketplace operated by RENTALS NJ LLC, located at 408 Provincetown Dr., Cape May, NJ 08204 ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website, platform, and services (collectively, the "Platform"). By accessing or using NewJersey.Rentals, you agree to be bound by these Terms.

1. Definitions

  • "Platform" refers to the NewJersey.Rentals website and services.

  • "User" refers to any individual or entity using the Platform, including both Guests and Hosts.

  • "Host" is a User who lists a property for rent.

  • "Guest" is a User who books a listed property.

2. Platform Overview

NewJersey.Rentals is a peer-to-peer short-term vacation rental marketplace focused on properties across New Jersey, particularly the Jersey Shore. We process bookings and payments via Stripe, handle applicable taxes, and charge Guests an 11% service fee per booking. Hosts list for free and are required to verify their identity through Stripe.

We do not own, manage, or operate any of the properties listed. We are not a party to the rental agreement between Host and Guest.

3. Eligibility and Account Registration

To use the Platform, you must be at least 18 years old. Hosts must:

  • Be at least 18 years old,
  • Have legal ownership or legal rights to list the property,
  • Successfully verify their identity through Stripe.

You are responsible for maintaining the confidentiality of your account credentials.

4. Listing and Booking

  • Hosts may list either entire properties or shared spaces.
  • All listings must include accurate photos, descriptions, and availability.
  • Listings are reviewed periodically by our team for accuracy and potential fraud.
  • Guests can browse and book properties. All payments are processed via Stripe.
  • Listings are displayed based on an algorithm that considers reviews, listing accuracy, and other quality metrics.

5. Fees and Payments

  • Guest Fee: Guests are charged an 11% platform service fee per booking.
  • Host Fee: No fees are charged to Hosts.
  • Taxes: We collect and remit applicable state and local occupancy taxes on behalf of Hosts. See http://newjersey.rentals/p/taxes for a detailed tax breakdown.
  • Security Deposits: Hosts may require a refundable security deposit ranging from $100 to $1,000. See http://newjersey.rentals/p/deposits for details.

6. Cancellation Policies

Cancellation policies are predefined by our platform and must be selected by the Host at the time of listing creation. A dedicated explanation of each policy is available at http://newjersey.rentals/p/cancellation

7. ID Verification

All Hosts must complete ID verification through Stripe. Listings will not be published unless verification is successful. We reserve the right to suspend or remove any listing or account failing verification.

8. Content Ownership and License

Hosts retain ownership of content (photos, descriptions, etc.) they upload. However, by posting content, you grant RENTALS NJ LLC a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, promote, and display the content on our Platform, in marketing materials, and across social media channels. This license remains in effect even after the content is removed or the account is deleted, to allow reasonable time for operational and promotional activities to conclude. We are not obligated to remove past posts or shared content retroactively.

9. Platform Moderation

We reserve the right to moderate, edit, or remove any content, listing, or user account that violates these Terms or is deemed fraudulent, inaccurate, or harmful to the community.

10. Dispute Resolution

We aim to provide a neutral, fair resolution process. In the event of a dispute, we ask both parties to provide evidence. Our support team will offer a good-faith resolution based on submitted documentation, but we are not liable for the final outcome of disputes between Users.

11. No Insurance Provided

We do not provide insurance coverage for properties, Guests, or Hosts. Users are encouraged to obtain their own short-term rental insurance.

12. Prohibited Activities

You agree not to:

  • Post false or misleading listings,
  • Violate any laws or third-party rights,
  • Use the platform for fraud, scams, or illegal conduct,
  • Circumvent platform fees or policies

13. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our discretion, with or without notice, if you violate these Terms or engage in misconduct.

14. Limitation of Liability

We are not liable for any damages arising from your use of the Platform, including property damage, personal injury, disputes, or cancellations. Our liability is limited to the amount of fees we received from your transactions in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless RENTALS NJ LLC, its officers, directors, and employees, from any claims, damages, liabilities, costs, or expenses arising from your use of the Platform or your breach of these Terms.

16. Third-Party Services

Payment processing is handled by Stripe and is subject to the Stripe Connected Account Agreement. By using the Platform, you also agree to be bound by Stripe’s terms in addition to these Terms of Service.

17. Force Majeure

We are not liable for any delay or failure in performance due to events beyond our reasonable control, including but not limited to natural disasters, war, governmental actions, labor disputes, power or Internet outages, or other unforeseen events.

18. Changes to Terms

We reserve the right to update these Terms at any time. We will notify Users of significant changes. Continued use of the Platform after changes constitutes acceptance.

19. Governing Law

These Terms shall be governed by the laws of the State of New Jersey. Any legal proceedings shall take place in the courts located in Cape May County, New Jersey.
